General Terms and Conditions for Online Sales at FASHION ELITE

These general terms and conditions are drafted in accordance with the Slovenian Consumer Protection Act (ZVPot), Obligations Code (OZ), Personal Data Protection Act (ZVOP-1), and the Electronic Communications Act (ZEKom-1). These general terms and conditions govern the operation of the online store, the rights and obligations of the user and the store, and regulate the business relationship between the seller and the buyer. The buyer is bound by the terms and conditions that are valid at the time of purchase (placing an online order).

Prices

​

All prices are in Euros (€) and include VAT. The stated prices are valid only for purchases made within the FASHION ELITE online store. FASHION ELITE reserves the right to change prices daily without prior notice. Prices are valid at the time of order placement and do not have a predetermined validity. If a price is incorrect or if the price of an item changes during order processing, the seller will enable the buyer to withdraw from the purchase or will withdraw from the sale, while striving to find a solution that will be mutually satisfactory.

Online Store

A visitor can make a purchase by registering as a guest (hereinafter also referred to as the buyer) and thus acquire the right to purchase in the online store.

Orders

​

After placing an order, you will receive an email confirmation, confirming that the order has been received and is in the queue. Usually, you will receive the email immediately; however, the receipt time may be extended due to different email client settings. The sales contract is concluded when FASHION ELITE confirms the order (the buyer receives an email with the order status confirmed). From that moment, prices and other conditions of sale are fixed and apply to both the buyer and FASHION ELITE.

FASHION ELITE reserves the right to reject an order if the item is no longer in stock or if there are pricing errors that may occur due to automated transfers, of which you will be notified as soon as possible. In case of ambiguities, verification of data, or ensuring correct delivery, we may call you at the phone number you provided when placing the order.

The seller reviews the order, checks the availability of the ordered items, and either confirms or rejects the order with a reason. FASHION ELITE may call the buyer at their contact phone number to verify data or ensure accurate delivery. If items that FASHION ELITE does not have in stock in its own warehouse are ordered, the buyer will be promptly informed about the delivery of the items.

Goods will be prepared for personal pickup within the agreed timeframe. You will receive a notification by email when the items are ready for pickup.

If you have ordered goods that, due to unforeseeable reasons, cannot be delivered within the stated timeframe, you will be informed about the new delivery time by phone or email.

FASHION ELITE does not assume any responsibility for damage caused by longer delivery times or non-delivery of items that are not in stock in its own warehouse.

Upon receipt of the payment, we will complete your order and include the invoice with the goods, which you will receive upon pickup or delivery. The invoice clearly itemizes the price and all costs associated with the purchase. The buyer is obliged to check the accuracy of the data before placing the order. Subsequent objections regarding the accuracy of issued invoices will not be considered.

Order Cancellation

​

Orders placed through the online store can be canceled by consumers within 2 (two) days of purchase. Order cancellation must be notified via email to info@fashion-elite.com. In the email, please provide your name, surname, address, order number, and state "Order Cancellation" in the subject line. The cancellation is confirmed when you receive a written confirmation from FASHION ELITE.

Product Pickup and Delivery

​

Ordered products can be picked up at the seller's premises once you receive a notification that the goods are ready for pickup or via delivery.

Due to holidays or weekends, the pickup time may be extended, so we ask for your understanding. If we cannot deliver the order within the promised timeframe due to unforeseen reasons, you will be informed about the new delivery time by phone or email.

Right to Withdraw from Purchase

​

If you wish to withdraw from the purchase for any reason, you can notify us in writing within 5 (five) days to the address below or via email to info@fashion-elite.si without having to state a reason. The 5-day period begins on the day you received the goods. The only cost that the buyer bears in connection with the withdrawal from the contract is the cost of returning the goods.

The buyer does not have the right to withdraw from the purchase of products that were made according to the exact instructions of the buyer and were tailored to their personal needs, and consequently, due to their nature, are not suitable for return (personalized pajamas, custom-made products).

If you have already received the goods and are withdrawing from the contract, you must return the goods undamaged, in their original packaging, and in the same quantity to FASHION ELITE within 3 days of sending the written notification of withdrawal from the contract (purchase). The goods must be returned together with all accompanying documentation and the invoice. If you return the received goods, we will refund the purchase price as soon as possible, but no later than 14 days after the return of the items.

The consumer may not freely use the products until withdrawal from the contract. The consumer may inspect and test the products to the extent necessary to determine their actual condition. The consumer is responsible for any reduction in the value of the goods.

​

Refunds will be made no later than 14 days from the receipt of the notice of withdrawal. To ensure certainty, accuracy, and timely refund and to keep a record of payments, the refund to the buyer is made exclusively by transfer to their transaction account. Upon withdrawal from the contract where a coupon or discount code was used, these funds are considered a discount and are not refunded to the user. Only the amount paid is refunded to the user's bank account.

Working hours: Monday to Friday from 7:00 AM to 3:00 PM. For personal returns of goods, you must make prior arrangements, which can be communicated to the above email address or phone. When returning goods, it is necessary to provide the invoice along with the goods. Complaints, comments, requests, and suggestions can also be sent to the above address or by email to info@fashion-elite.si.

We have ensured that every online purchase is safe. All confidential data transmitted over the internet (personal data, purchase information, and credit card numbers) are properly encrypted, making them unreadable to third parties.

FASHION ELITE commits to fully protecting, securing, and processing personal data obtained through the online store in accordance with the Personal Data Protection Act.

Data is adequately protected against loss, destruction, forgery, manipulation, unauthorized access, or unauthorized disclosure to third parties. User data will not be disclosed to unauthorized persons under any circumstances.

Personal data obtained through the website for the purpose of executing an online purchase is used solely for order fulfillment.

Limitation of Liability

The content published on the website may be used and reproduced only for non-commercial purposes, while retaining all copyright and other proprietary notices.

FASHION ELITE strives to provide the most up-to-date and accurate content on its websites but does not assume any guarantees or warranties for the timeliness and/or accuracy of the published information. The features of certain items, delivery time, or price may change so quickly that the online service provider does not manage to correct the information on the website. In such a case, FASHION ELITE will inform the buyer of the changes and allow them to withdraw from the contract or exchange the ordered item.

FASHION ELITE, or any other legal or natural person involved in the creation and production of the website, is not liable for any damage arising from access to, use of, or inability to use the information on the website or for any errors or deficiencies in its content.
